You agree not to:

  • Use Skimle for any unlawful or unauthorized purpose.
  • Attempt to interfere with or disrupt the service, servers, or networks.
  • Reverse engineer, duplicate, or resell any part of the platform.

We kindly request that you do not upload documents containing sensitive personal data, such as medical records, or highly confidential government files to the service running at Skimle.com. To learn about options for processing sensitive data, contact us at info@skimle.com.

5. Prohibited High-Risk and Restricted AI Uses (EU AI Act)

Skimle has not been designed, tested, or certified as a "high-risk AI system" under Regulation (EU) 2024/1689 (the "EU AI Act") and is not intended for use in any application that the EU AI Act classifies as prohibited or high-risk.

Scope. This section applies to you if (a) you or your organisation is established or located in the European Union or European Economic Area; (b) you use Skimle to process data concerning, or to produce outputs that materially affect, natural persons located in the EU/EEA; or (c) the output of your use of Skimle is otherwise put into service or used within the EU/EEA — regardless of your nationality or place of establishment.

Prohibited uses. Where this section applies, you agree not to use Skimle, on its own or as a component of another system, for any of the following purposes:

  • Any practice prohibited by Article 5 of the EU AI Act, including but not limited to: social scoring of natural persons; inference of emotions of natural persons in the workplace or in educational institutions; subliminal or manipulative techniques that materially distort behaviour; exploitation of vulnerabilities due to age, disability, or socio-economic situation; or untargeted scraping of facial images.
  • Employment, recruitment, and workforce management — including analysing CVs, applications, interview recordings or transcripts, performance reviews, or other materials in order to filter, rank, score, profile, evaluate, or otherwise inform decisions about recruitment, hiring, promotion, task allocation, monitoring, or termination of natural persons.
  • Education and vocational training — including determining access or admission to educational institutions, assigning persons to programmes, evaluating learning outcomes, assessing the appropriate level of education, or detecting prohibited behaviour during tests.
  • Access to essential private and public services — including evaluating creditworthiness or credit scores, risk assessment and pricing in life or health insurance, evaluating eligibility for public benefits, or dispatching emergency services.
  • Biometric identification, biometric categorisation, or emotion recognition of natural persons.
  • Law enforcement, migration, asylum, and border control — including risk profiling, lie detection, evaluating the reliability of evidence, or assessing the risk posed by a natural person.
  • Administration of justice and democratic processes — including assisting judicial authorities in researching or interpreting facts or law, or influencing elections, referenda, or voting behaviour.
  • Any other use case listed in Annex III of the EU AI Act, or any use that would cause Skimle to be classified, certified, or registered as a high-risk AI system.

Your responsibility as deployer. If you use Skimle to support any decision-making about natural persons, you act as the "deployer" within the meaning of the EU AI Act and remain solely responsible for compliance with all applicable EU and national laws, including the EU AI Act, the GDPR, and any sector-specific rules. You confirm that you have a lawful basis and, where required, have carried out a fundamental-rights impact assessment and/or data protection impact assessment before using the service.

Enforcement. We may suspend or terminate your access without notice if we reasonably suspect a breach of this section. You agree to indemnify Skimle for any claims, fines, or losses arising from a prohibited use.
